OVERVIEW

Welcome to Book Bunny.

The terms "Book Bunny," "we," "us," and "our" refer to Book Bunny LLC, a Nevada limited liability company.

Book Bunny operates this store and website, including all related information, content, features, tools, products, and services, in order to provide customers and visitors with a curated shopping and content experience (collectively, the "Services"). Book Bunny is powered by Shopify, which enables us to provide the Services.

These Terms of Service ("Terms"), together with any policies expressly referenced or incorporated into these Terms, govern your access to and use of the Services and describe your rights and responsibilities.

Please read these Terms carefully. They contain important provisions regarding orders, cancellations, intellectual property, warranty disclaimers, limitations of liability, governing law, and venue.

By visiting, accessing, interacting with, or using the Services, you agree to be bound by these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, you should not access or use the Services.

When you place an order through the Services, you also agree to the Terms and policies presented or linked in connection with that transaction, including our Returns, Refunds, Cancellations & Order Policy.

Nothing in these Terms limits any right or remedy that applicable law expressly prohibits a consumer from waiving by contract.

SECTION 1 - ACCESS AND ACCOUNTS

You must have the legal capacity required in your jurisdiction to enter into a binding transaction with Book Bunny when purchasing products or otherwise entering into an agreement through the Services.

If you permit a minor to access or use the Services through a device or account that you own, purchase, manage, or control, you are responsible for that access to the extent permitted by applicable law.

To use certain portions of the Services or make a purchase, you may be asked to provide information including your name, email address, billing information, payment information, and shipping information. You represent and warrant that information you provide to Book Bunny is accurate, current, and complete and that you are authorized to provide and use that information.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You may not sell, transfer, assign, sublicense, or otherwise provide your account to another person without our prior permission.

Book Bunny may suspend, restrict, or terminate access to an account where we reasonably believe such action is necessary because of suspected fraud, abuse, unlawful activity, security concerns, violations of these Terms, operational risk, or conduct that may harm Book Bunny, Shopify, our service providers, our customers, or others.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately describe and display our products. However, product colors, proportions, appearance, placement, texture, and other characteristics may appear differently depending on your screen, device, browser, display settings, lighting, manufacturing process, printing process, materials, and other factors.

Product photographs, digital mockups, illustrations, lifestyle images, and other visual representations are provided to help demonstrate the product and may not depict every minor variation that can occur in the finished item.

Many Book Bunny products are made to order. Measurements, print placement, stitching, color, fabric texture, and other production characteristics may vary within ordinary manufacturing or production tolerances. Minor variations inherent in printing, manufacturing, materials, or made-to-order production are not necessarily defects.

Nothing in this section limits rights or remedies relating to products that are damaged, defective, materially different from their description, incorrect, or otherwise subject to a remedy under applicable law or our Returns, Refunds, Cancellations & Order Policy.

We may modify product descriptions, designs, specifications, available colors, product offerings, or availability at any time before an order is accepted. We may discontinue any product at any time and may limit quantities offered or sold to any person, household, geographic area, jurisdiction, account, or payment method.

SECTION 3 - ORDERS

When you submit an order, you are making an offer to purchase the products identified in the order subject to these Terms and our applicable policies.

Book Bunny reserves the right, where permitted by applicable law, to decline, cancel, restrict, or require additional verification for an order before fulfillment. This may include circumstances involving suspected fraud or unauthorized payment activity, payment processing problems, inaccurate or incomplete customer information, product or material unavailability, pricing or listing errors, shipping or geographic restrictions, suspected commercial resale, circumvention of quantity limits, export or legal restrictions, or other circumstances that reasonably prevent fulfillment of the order.

An order is generally accepted after successful payment processing and issuance of an order confirmation. Book Bunny may request additional information or verification before accepting or fulfilling an order.

Please review your order carefully before submitting it.

24-Hour Cancellation Period

Book Bunny voluntarily permits customers to request cancellation within 24 hours of purchase, as described in our Returns, Refunds, Cancellations & Order Policy.

After the 24-hour cancellation period has expired, an order may be released for made-to-order production. Because products are made to order, orders generally cannot be cancelled after production has begun, except where cancellation is required by applicable law.

Order changes may be requested during the 24-hour cancellation period but cannot be guaranteed. If a requested change cannot be made, you may cancel the order within the applicable cancellation period and place a new order.

If Book Bunny cancels an order after payment has been collected and no substitute transaction is agreed upon, the amount paid for the cancelled order will be refunded as required by applicable law.

Purchases are subject to our Returns, Refunds, Cancellations & Order Policy, which is incorporated into these Terms by reference. Nothing in these Terms eliminates a statutory cancellation right that applicable law expressly prohibits a consumer from waiving.

You represent that purchases made through the Services are for legitimate personal, household, gift, or other lawful purposes. You may not use the Services to place orders for unauthorized commercial resale, fraudulent activity, infringement, unlawful export, circumvention of purchasing restrictions, or other prohibited purposes.

SECTION 4 - PRICES, TAXES AND BILLING

Prices, discounts, promotions, availability, and offers may change without notice before an order is placed.

The price applicable to an order will generally be the price displayed during checkout and reflected in the order confirmation, subject to correction of errors as permitted by applicable law.

Unless expressly stated otherwise, displayed product prices may not include shipping charges, sales or other applicable taxes, customs duties, brokerage charges, import charges, or other government-imposed or carrier-related charges that may apply to a transaction. Any charge required by applicable law to be disclosed before purchase will be disclosed as required.

Promotions may be subject to separate terms or eligibility requirements. If promotional terms conflict with these Terms, the more specific promotional terms will control with respect to that promotion.

You agree to provide accurate and complete purchase, payment, billing, shipping, and account information. By providing a payment method, you represent and warrant that you are authorized to use that payment method and authorize applicable charges associated with the transaction.

Payment processing may be performed by Shopify or other payment-service providers and may be subject to their respective terms and privacy practices.

If a material pricing, listing, or availability error affects an order, Book Bunny may contact you to correct the transaction or cancel the affected order where permitted by law. If Book Bunny cancels an accepted order because of such an error after payment has been collected, the amount paid for the cancelled portion of the order will be refunded as required by applicable law.

SECTION 5 - SHIPPING AND DELIVERY

Shipping and delivery dates are estimates unless expressly stated otherwise.

Production and delivery may be affected by circumstances including production schedules, manufacturer or fulfillment-provider delays, carrier operations, customs processing, weather, labor interruptions, service disruptions, supply shortages, governmental action, and other circumstances outside Book Bunny's reasonable control.

Book Bunny is not responsible for ordinary carrier delays or delivery problems caused by an incorrect or incomplete shipping address provided by the customer, except to the extent otherwise required by applicable law.

Customers should monitor the tracking information provided with their order and contact the applicable shipping carrier regarding routine tracking questions, carrier delays, or delivery-status updates.

Nothing in these Terms transfers risk of loss to a customer earlier than permitted by applicable law or limits Book Bunny's obligations with respect to an order that is confirmed lost in transit, not delivered, damaged, defective, incorrect, or otherwise subject to a remedy that cannot lawfully be waived.

If an order is confirmed lost in transit or another delivery problem requires action by Book Bunny, please contact us in accordance with our Returns, Refunds, Cancellations & Order Policy.

Title to and risk of loss for products pass as determined by the applicable sales contract and governing law.

SECTION 6 - INTELLECTUAL PROPERTY AND COPYRIGHT

The Services and their contents include intellectual property owned by or licensed to Book Bunny LLC and other parties. This includes, where applicable, trademarks, trade names, logos, character names and designs, illustrations, artwork, photographs, graphics, product designs, text, journal content, group-chat content, blog content, written materials, audiovisual materials, layouts, website design, icons, compilations, and other creative or proprietary materials.

Original Book Bunny content is protected by applicable United States and international copyright, trademark, trade dress, unfair competition, and other intellectual property laws.

Book Bunny™, Book Bunny character identities, Book Bunny branding, and associated names, logos, designs, slogans, and source identifiers are proprietary to Book Bunny LLC or used under license.

No license to use Book Bunny trademarks, copyrighted content, characters, artwork, written content, or other proprietary materials is granted except as expressly stated in these Terms.

You may access and use the Services solely for personal, lawful, non-commercial purposes unless Book Bunny expressly authorizes otherwise in writing.

Except as expressly permitted by applicable law or by prior written permission from Book Bunny LLC, you may not reproduce, copy, distribute, republish, modify, adapt, translate, create derivative works from, publicly display, publicly perform, transmit, sell, license, commercially exploit, or otherwise use protected Book Bunny content.

Purchasing a Book Bunny product does not transfer any copyright, trademark, character right, design right, trade dress right, or other intellectual-property ownership to the purchaser.

Ordinary personal use of a lawfully purchased product, including photographing or displaying the product for personal social-media use, does not by itself violate this section.

Artificial Intelligence and Machine Learning

Except with Book Bunny LLC's prior written permission or where a restriction is prohibited by applicable law, Book Bunny content may not be scraped, copied, extracted, downloaded, compiled, reproduced, ingested, or otherwise used for artificial-intelligence training, machine-learning training, large language model training, generative model development, model testing or evaluation, benchmarking, dataset creation or enrichment, model improvement, synthetic-content generation, automated character replication, or similar technological uses.

No permission is granted to use Book Bunny content as training data, reference data, source material, or input for datasets, models, generative systems, machine-learning systems, or systems intended to reproduce, imitate, approximate, or derive from Book Bunny characters, artwork, writing, designs, or other protected expression.

Nothing in these Terms grants any intellectual-property license by implication, estoppel, or otherwise. All rights not expressly granted are reserved.

Shopify's names, logos, products, service names, designs, and slogans are intellectual property of Shopify or its licensors. Other third-party names, marks, designs, images, and materials remain the property of their respective owners.

Failure by Book Bunny to enforce an intellectual-property or copyright restriction on one occasion does not waive our right to enforce that restriction in the future.

SECTION 7 - OPTIONAL TOOLS AND FEATURES

We may provide access to tools, integrations, applications, features, or services offered or operated by third parties.

Unless expressly stated otherwise, Book Bunny does not control third-party tools and does not guarantee their availability, performance, security, accuracy, functionality, or suitability. Third-party tools may be provided "as is" and "as available" to the fullest extent permitted by applicable law.

Your use of third-party tools may be subject to separate terms, conditions, or privacy policies imposed by the applicable third party.

We may add, modify, suspend, or remove features, tools, resources, or integrations from the Services. New features made available through the Services may also be governed by these Terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain hyperlinks, embedded functionality, references, or materials supplied by third parties.

Book Bunny does not control and is not responsible for the content, availability, security, accuracy, policies, or practices of third-party websites or services.

If you access or use a third-party website or service, you do so subject to the terms and policies applicable to that third party.

To the fullest extent permitted by law, Book Bunny is not responsible for losses, damages, disputes, products, services, resources, or content arising from a third-party website or transaction separate from the Services.

Questions, complaints, or disputes involving third-party products or services should generally be directed to the applicable third party unless Book Bunny has an independent legal obligation concerning the matter.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Book Bunny is powered by Shopify, which enables us to provide the Services. However, sales and purchases made through the Book Bunny Store are made directly between you and Book Bunny LLC.

Shopify is not the seller of Book Bunny products.

To the fullest extent permitted by applicable law, Shopify is not responsible for injuries, losses, claims, damages, product defects, or disputes arising solely from products purchased from Book Bunny or transactions between you and Book Bunny.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from purchases and transactions with Book Bunny for which Shopify is not legally responsible.

SECTION 10 - PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

Certain information may also be processed independently by Shopify under the Shopify Consumer Privacy Policy.

By accessing or using the Services, you acknowledge that you have been provided access to the applicable privacy policies.

Because the Services are hosted by Shopify, Shopify may collect and process information regarding access to and use of the Services in order to provide, secure, operate, and improve Shopify services.

Please review our Privacy Policy for additional information concerning how Book Bunny, Shopify, service providers, and other parties may collect, use, disclose, retain, or otherwise process personal information.

SECTION 11 - FEEDBACK, REVIEWS AND SUBMISSIONS

If you voluntarily submit, upload, post, email, transmit, or otherwise provide Book Bunny with ideas, suggestions, feedback, reviews, photographs, comments, proposals, recommendations, or other content ("Feedback"), you retain any ownership rights you may have in that Feedback.

By providing Feedback, however, you grant Book Bunny LLC a perpetual, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, display, distribute, publish, adapt, format, edit, translate, promote, advertise, and otherwise use the Feedback in connection with Book Bunny, the Services, and Book Bunny's business, including in marketing, advertising, social media, website content, promotional materials, and other commercial or non-commercial communications.

You represent and warrant that you own or otherwise have the rights necessary to provide the Feedback and grant the license described above; that the Feedback does not infringe or violate another person's copyright, trademark, privacy, publicity, personality, contractual, or other rights; that it does not contain unlawful, defamatory, fraudulent, threatening, abusive, malicious, obscene, or harmful content; and that it does not contain malware, viruses, or malicious code.

If you received free products, discounts, compensation, incentives, or another material benefit in connection with a review or other Feedback, you are responsible for making any disclosure required by applicable law.

Unless separately agreed in writing, Book Bunny is not obligated to keep unsolicited Feedback confidential, compensate you for unsolicited Feedback, use Feedback, or respond to Feedback.

Book Bunny may moderate, refuse to publish, edit, or remove Feedback where permitted by applicable law and platform rules. You remain responsible for Feedback you submit.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies, outdated information, or omissions relating to product descriptions, pricing, product availability, promotions, discounts, shipping charges, production times, transit times, product specifications, or other information.

Subject to applicable law, Book Bunny reserves the right to correct errors, inaccuracies, or omissions and to update information.

If a material pricing, listing, availability, or product-information error affects an order, Book Bunny may contact you to correct the transaction or cancel the affected order where permitted by applicable law.

If Book Bunny cancels an accepted order because of an error after payment has been collected, the amount paid for the cancelled portion of the order will be refunded as required by applicable law.

SECTION 13 - PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services, directly or indirectly, to violate applicable international, federal, state, provincial, territorial, or local law; infringe or misappropriate intellectual-property or proprietary rights; engage in fraud, deception, impersonation, harassment, abuse, threats, or unlawful discrimination; transmit knowingly false or materially misleading information; distribute malware, viruses, malicious code, or harmful technology; send unauthorized spam or bulk solicitations; interfere with the operation, security, availability, or integrity of the Services; bypass access controls, security measures, CAPTCHAs, robot exclusion protocols, or technical restrictions; access another person's account without authorization; collect or track personal information about others without lawful authorization; reproduce, resell, or commercially exploit portions of the Services without authorization; engage in unauthorized scraping, crawling, indexing, mirroring, data mining, extraction, or systematic copying; use bots, spiders, scrapers, automated agents, AI tools, or other automated systems to access or extract content contrary to these Terms or technical restrictions; use Book Bunny content for artificial-intelligence or machine-learning purposes prohibited by Section 6; circumvent quantity limits or purchasing restrictions; engage in unauthorized commercial resale; or otherwise interfere with Book Bunny's rights, security, systems, or business operations.

Book Bunny may use reasonable technical, contractual, administrative, or other measures to prevent or restrict prohibited activity and, where permitted by applicable law, may suspend or terminate access for violations of this section.

SECTION 14 - AUTOMATED AGENTS

For purposes of these Terms, an "Agent" means software or a service that acts autonomously or semi-autonomously on behalf of, or at the direction of, a person or entity when accessing or interacting with the Services.

An Agent may not access or interact with the Services contrary to these Terms, Book Bunny's technical restrictions, robot exclusion protocols, access-control measures, or instructions communicated through the Services.

We may restrict whether and how Agents access or interact with the Services.

Where technically applicable, an Agent accessing the Services must not intentionally conceal its automated nature, falsely represent itself as a human user, mimic human behavior for the purpose of circumventing restrictions, bypass CAPTCHAs or similar measures, bypass rate limits or access controls, or evade measures intended to regulate automated access.

Nothing in this section grants an Agent, developer, operator, model provider, platform, or other person permission to scrape, copy, reproduce, train on, extract, or otherwise use Book Bunny content in violation of these Terms.

SECTION 15 - SUSPENSION AND TERMINATION

Book Bunny may suspend, restrict, or terminate access to all or part of the Services where reasonably appropriate, including for violations of these Terms, suspected fraud, unlawful activity, abuse, security concerns, misuse, technical threats, intellectual-property violations, or conduct that creates risk to Book Bunny, Shopify, service providers, customers, or others.

Termination or suspension of website or account access does not eliminate rights or obligations associated with transactions already completed or accepted. You remain responsible for amounts lawfully owed for completed or accepted transactions, and termination does not limit any non-waivable consumer right.

Provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property and copyright, Feedback, disclaimers, limitations of liability, indemnification, governing law, venue, and accrued rights or obligations.

SECTION 16 - DISCLAIMER OF WARRANTIES

Nothing in these Terms excludes or limits any warranty, condition, guarantee, right, or remedy that applicable law expressly prohibits Book Bunny from excluding or limiting.

Book Bunny's obligations concerning damaged, defective, incorrect, lost, or non-delivered products are also subject to our Returns, Refunds, Cancellations & Order Policy and applicable law.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR WARRANTIES OR CONDITIONS EXPRESSLY PROVIDED BY BOOK BUNNY OR REQUIRED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOOK BUNNY DISCLAIMS IMPLIED WARRANTIES OR CONDITIONS THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WHERE APPLICABLE LAW REQUIRES A WARRANTY, CONDITION, GUARANTEE, OR REMEDY THAT CANNOT BE DISCLAIMED, THAT RIGHT REMAINS IN EFFECT ONLY TO THE EXTENT REQUIRED BY LAW.

Book Bunny does not warrant that website access will always be uninterrupted, timely, secure, available, or error-free.

Information provided through the Services is generally provided for informational and entertainment purposes and is not intended as professional legal, medical, financial, tax, or other specialized advice.

SECTION 17 - LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability to the extent applicable law expressly prohibits such liability from being excluded or limited.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOOK BUNNY LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, OR SIMILAR ECONOMIC OR CONSEQUENTIAL LOSSES ARISING OUT OF OR RELATING TO THE SERVICES, THESE TERMS, OR A PRODUCT OR TRANSACTION.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED BUT MAY LAWFULLY BE LIMITED, BOOK BUNNY'S AGGREGATE LIABILITY ARISING OUT OF A PARTICULAR PRODUCT, ORDER, TRANSACTION, OR EVENT WILL NOT EXCEED THE AMOUNT PAID TO BOOK BUNNY FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM, EXCEPT TO THE EXTENT APPLICABLE LAW REQUIRES OTHERWISE.

These limitations do not apply to any liability that applicable law expressly prohibits Book Bunny from excluding or limiting. Some jurisdictions may not permit certain exclusions or limitations, and in those jurisdictions this section applies only to the maximum extent permitted by law.

SECTION 18 - INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Book Bunny LLC, Shopify, and their respective affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, judgments, and reasonable costs, including reasonable attorneys' fees, arising from or relating to your material breach of these Terms; your unlawful or unauthorized use of the Services; your violation of applicable law; your infringement or violation of another person's intellectual-property, privacy, publicity, contractual, or other rights; Feedback or content you submit; or fraudulent, abusive, or malicious conduct associated with your use of the Services.

This indemnification obligation does not apply to the extent a claim results from conduct for which Book Bunny or another indemnified party is legally responsible and liability cannot lawfully be transferred to you.

Book Bunny may participate in or control the defense of an indemnifiable third-party claim where reasonably appropriate, and you agree to provide reasonable cooperation in connection with such defense.

Nothing in this section requires a consumer to waive any right that applicable law expressly prohibits the consumer from waiving.

SECTION 19 - FORCE MAJEURE

Book Bunny will not be liable for delay or failure to perform an obligation caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, earthquake, epidemics or public-health emergencies, war, terrorism, civil unrest, governmental action, labor disputes, strikes, carrier interruptions, customs delays, manufacturing interruptions, fulfillment-provider disruptions, supply shortages, utility failures, telecommunications outages, internet or platform outages, cybersecurity incidents beyond Book Bunny's reasonable control, or similar events outside our reasonable control.

Performance may be delayed or suspended for the duration of the affected circumstances.

Nothing in this section permits Book Bunny to retain payment where applicable law requires cancellation, reimbursement, or another mandatory remedy because an order ultimately cannot be fulfilled.

SECTION 20 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, void, or unenforceable, that provision will be interpreted or reformed to the minimum extent necessary to make it enforceable to the fullest extent permitted by law.

If such interpretation or reformation is not possible, the unenforceable portion will be severed. The remaining provisions will continue in full force and effect unless applicable law requires otherwise.

SECTION 21 - WAIVER; ENTIRE AGREEMENT

Book Bunny's failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies, transaction terms, and other provisions expressly incorporated by reference, constitute the agreement governing your use of the Services and transactions with Book Bunny to the extent permitted by applicable law.

These Terms supersede prior or contemporaneous communications or understandings concerning the same subject matter, except where applicable law requires a representation, disclosure, warranty, or right to remain part of the transaction.

Nothing in this section excludes or eliminates a statutory protection that cannot lawfully be waived.

SECTION 22 - ASSIGNMENT

You may not assign, delegate, transfer, or otherwise convey your rights or obligations under these Terms without Book Bunny's prior written consent, except where applicable law provides otherwise.

Book Bunny may assign or transfer these Terms and related rights or obligations, without customer consent to the extent permitted by law, in connection with a merger, acquisition, reorganization, financing, sale of assets, restructuring, change of control, transfer to an affiliate, sale of the business, or similar transaction or succession.

Any assignment remains subject to rights or obligations that applicable law expressly prohibits from being eliminated or reduced.

SECTION 23 - GOVERNING LAW AND VENUE

Nothing in this section waives any protection, right, remedy, or forum that applicable law expressly prohibits a consumer from waiving by contract.
